K. Metzler called the IWWC meeting to order at 7:30 P.M.

Regular Meeting

File W2007-06- Application for Activity within the Regulated Area for the construction of a two car garage located at 22 Old River Road (Map 43, Lot 7).  Owner/Applicant Michael Anthony Robertino.  (Received on 2/26/07, Hearing or Decision by 4/23/07).

A tentative site walk was scheduled for 3/24/07 at 9:30 A.M.

File W2007-03-Application for Drainage Improvements within regulated area including catch basin at 90 Tinkerville Road (Map 40, Lot 41, Zone R 80) Owner: David Hammaker; Applicant; Benny Pagani of Titan General Contractors, LLC.  (Received 1/22/07, Public Hearing by 3/26/07; Decision by 4/23/07)

A site walk was scheduled for 3/24/07 following site walk for application W2007-06.

File W2007-04- Application for Re-subdivision of Lot 7 on property at Mihaliak Rd. Ext. and Rosemary Lane (Map 50, Lot 3-7, Zone R80)  Owner/Applicant: Mary C. Litwinczyk & Litwinczyk Children, LLC  (Received 1/22/07, Public hearing by 3/26/07; Decision by 4/23/07)

A site walk was scheduled for 3/24/07 following site walk for application W2007-03.


Old Business

W2006-59/ W2006-49- Proposed activity within regulated area for proposed 60 condo development on River Road; Application for  ruling of no jurisdiction for proposed subdivision on River Rd. (Map 10, Lot 21-0A, Zone R80)  Owner/Applicant: Willington River Corp.  (Received 10/23/06, Public hearing on 12/11/06, continued to 1/8/07, 35 day extension re1quested and approved, continued to 1/22/07; 2/12/07, Decision by 3/12/07)

K. Metzler said that the most pertinent information that the commission needs to go over is the town engineer’s report.  D. Schreiber said that he would like staff to send each commission member a copy of the reports.  
G. Blessing asked if Karl Asomovic will have some responsibility in providing guidance as to the maintenance of the roads, etc in the future.  And if he does should he be allowed to see the proposed plans before they are approved.  G. Blessing said that he thinks that it might cause problems in the future if Mr. Asomovic is not involved from the start.  The commission said that they could not receive any input from Mr. Asomovic as the public hearing is closed.  D. Schreiber said that if the application goes to Planning and Zoning they can request that Mr. Asomovic is kept informed of the plans.  
K. Metzler reminded the commission that the engineer hired by the town to work on this project is an expert and his report should be looked at as an expert opinion.  

K. Metzler stated that he was concerned that the applicant did not propose any alternative plans, such as alternate locations for the drainage system.  He also said he was concerned with the velocity of storm water coming off the hill during construction.  
G. Blessing discussed the detention system and the steep slopes of the hill.  
K. Metzler discussed the review from DEP regarding the storm water measurements.  He asked G. Blessing to go over the calculations to see if he felt that they were correct.  L. Kouyoumjian stated that just because a calculation works on paper does not mean that the system will work in reality.  He suggested sending Mr. Asomovic the reports in advance so he can review them if the project moves on.  
K. Metzler said that if the project is approved then they must require a bond for potential damage.  The commission members discussed how a bond amount is determined.  K. Metzler said that if the project is approved then they need to write a letter to Planning and Zoning regarding their concerns regarding water flow onto other resident’s properties.  
The commission discussed peak flow and storm water events.  D. Schreiber asked if it would be possible to dig into the water table or to hit an aquifer during construction.  The commission discussed this.  
The commission discussed the nitrogen dilution levels.

K. Metzler asked the commission members to go through the engineer’s reports when they receive them as well as the town’s regulations so they are prepared to make a decision at the next meeting.  

Cease and Desist Order issued to Joseph Voboril Re: Clover Springs Subdivision Wetlands permit W2004-04 off Battye Road. Site walk 11/4/06 at 9a.m.

K. Metzler said that the town attorney was drafting a letter to Mr. Voboril.

W2003-49- Notice of Violation: TravelCenters of America (the lessess) and George Gigere of Royce Properties (the owner) of property located at 327 Ruby Road.

F. Dirrigl was not present to give his report.   

Correspondence

1.      Memo from DEP Pesticide Program regarding Aquatic Pesticide Permit Applications.
2.      Notice of Violation from DEP regarding pond on Route 320
3.      Notice of Public hearing on proposed general permits for various water diversion activities
4.      Pinelands Nursery and Supply 2007 Wholesale Catalog.

D. Schreiber made a motion to approve the minutes from 2/12/07.  G. Blessing seconded the motion.  All members voted in favor thus the motion carries.  

Staff Report and Discussion

K. Metzler asked staff to check if planting had been completed by applicant selling property on route 320 next to pond.  

The commission said that they would like to see comments from the town attorney regarding the cease and desist case.  

L. Kouyoumjian made a motion to adjourn at 8:20 P.M. G. Blessing seconded the motion.  All members voted in favor.
